You have requested DP Legal Solutions to assist you in transferring title to real estate. This means that we will prepare a deed for you. The deed will change who owns the real estate described in this workbook. Depending on how you complete this workbook, the deed will possibly take that real estate out of your name so that you are not the owner anymore.
There are two types of deeds in California.
GRANT DEED:
With a Grant Deed, the following promises are implied by law: That prior to the time of the execution of the grant deed, the grantor has not conveyed the real estate to any person other than the grantee, and that the real estate is at the time of the execution of the grant deed free from encumbrances (mortgages, liens, taxes, etc.).
QUITCLAIM DEED:
A Quitclaim Deed is often used to clear up problems with a title or when someone wants to use a simple method to give up all interests in a property. With a Quitclaim Deed, the grantor makes no promises of any kind with respect to the title of the property to the grantee.
Grant Deeds are always preferable to Quitclaim Deeds because a Grant Deed comes with the representations and warranties described above. A Quitclaim Deed provides no warranty of any kind. Title insurance companies always prefer Grant Deeds over Quitclaim Deeds.
Completing this workbook will result in a Grant Deed. If you desire a Quitclaim Deed instead, please notify us.
